1. Acceptance of Terms

By accessing or using the TechticalS website, platform or services (collectively, the "Services"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, do not use the Services.

2. About TechticalS

TechticalS ("TechticalS", "we", "us") provides web and mobile software development services, including free product demos, proposals, quotes, contracted development projects, maintenance plans and related billing. TechticalS is operated by a natural person based in Manizales, Caldas, Colombia. You can contact us at support@techticals.com.

3. Eligibility and Accounts

You must be at least 18 years old (or the legal age in your jurisdiction) to use the Services. You are responsible for keeping your account credentials confidential and for all activity under your account.

4. Free Demo and Proposals

Free demos and proposals are provided for evaluation purposes, without charge and without obligation. They do not constitute a final product and may differ from the eventual contracted deliverable. Submitting a demo or contact request does not create a development agreement.

5. Contracts, Projects and Delivery

Development work is performed under a separate agreement (project or contract). The agreement describes the scope, deliverables, milestones, acceptance criteria and delivery dates. Unless otherwise agreed, work begins after the agreement is signed and any required initial payment is received. You must review and accept deliverables within the period stated in the agreement. If you do not respond within that period, the deliverable may be deemed accepted to the extent permitted by law.

6. Subscriptions and Cancellation

Maintenance plans are recurring subscriptions. They renew automatically at the interval shown at purchase unless cancelled before the renewal date. You can cancel by emailing support@techticals.com at least fifteen (15) calendar days before the next renewal. Cancellation stops future renewals; it does not refund the current period, except where required by law. You keep access until the end of the paid period.

7. Prices, Currency and Taxes

Prices are shown in the currency indicated on the quote, invoice or checkout. Unless stated otherwise, prices do not include taxes, withholdings or banking fees. When a purchase is processed by Lemon Squeezy as Merchant of Record, Lemon Squeezy calculates and remits the applicable taxes and the amount shown at checkout includes those taxes. You are responsible for any taxes that apply to you and are not collected by the processor.

8. Payments and Merchant of Record

Payments may be processed by third-party providers, including Wompi for Colombia and Lemon Squeezy for international purchases. Stripe may be added in the future.

When you pay through Lemon Squeezy, Lemon Squeezy acts as the Merchant of Record for that purchase. Lemon Squeezy is the seller of record for the transaction, handles payment processing, calculates and remits applicable taxes, and appears as "Lemon Squeezy" on your bank or card statement. Your purchase is also subject to Lemon Squeezy's Terms of Service (https://www.lemonsqueezy.com/terms) and Privacy Policy (https://www.lemonsqueezy.com/privacy). TechticalS remains responsible for delivering the services.

By paying through any provider you also agree to that provider's terms of service and privacy policy. We do not store full card data on our servers; payment data is handled by the processor.

9. Refunds

Refunds and cancellations are governed by our Refund Policy, which is incorporated into these Terms by reference.

10. Intellectual Property

Unless otherwise agreed in writing, we retain all rights in our tools, templates, know-how and pre-existing materials. Final deliverables are assigned or licensed to you according to the terms of your project agreement.

11. Acceptable Use

You agree not to use the Services for unlawful, fraudulent, infringing or abusive purposes, or in any way that could damage, disable or overburden the Services.

12. Disclaimer of Warranties

The Services are provided "as is" and "as available", without warranties of any kind, express or implied, to the maximum extent permitted by law.

13. Limitation of Liability

To the maximum extent permitted by law, TechticalS will not be liable for indirect, incidental, special or consequential damages. Our total liability is limited to the amounts actually paid by you for the specific service giving rise to the claim.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Colombia. Any dispute will be submitted to the competent courts of Colombia, without prejudice to the mandatory consumer protections of your place of residence.

15. Changes

We may update these Terms from time to time. The updated version will be published on this page with its version number and effective date. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
